Terms of Service
1. Agreement
These Terms of Service ("Terms") are a binding agreement between you ("Customer", "you") and Design Master Solutions LLC ("Cabinet Project", "we", "us"), the company that makes Cabinet Project. They apply to the website at cabinetproject.app, the app at app.cabinetproject.app, the mobile and desktop apps, the client portal each company gets at <your-company>.cabinetproject.app, and the API (together, the "Service").
By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you accept for a company, you confirm you can bind that company.
2. Who can use it
Cabinet Project is a business-to-business service for cabinet dealers, installer crews and related trades. To use it you must be at least 18, able to enter into contracts, give accurate information when you register, and not be barred from the Service by law. Personal or consumer use is not covered by these Terms. Homeowners and other clients of a dealer who use the client portal do so as that dealer's clients; their relationship is with the dealer.
3. What the Service does
Cabinet Project helps a dealer run a cabinet job: manufacturer price lists and multipliers, quotes by cabinet SKU, kitchen layouts, the client portal with approvals and payments, orders to the manufacturer, delivery checks and claims, install scheduling, punch lists, invoices and optional QuickBooks Online sync. Some features use AI, described in section 7.
Cabinet Project is a new service and keeps evolving. We improve, change and occasionally remove features; we give at least 30 days' notice before removing a feature you pay for, except for urgent security or legal reasons.
4. Accounts and security
You are responsible for your account credentials, for everything done under your account, for giving each team member their own login, and for removing access when someone leaves. Tell us right away at info@designmastersolutions.com if you suspect unauthorized access. Do not share logins or use automated means to create accounts.
5. Plans, trial and billing
Plans and prices are published on our pricing section; that page, at the time you subscribe, is the price you pay. Every paid plan starts with a 14-day trial without a card. The Free plan is one user and three quick quotes a month, with a Cabinet Project branded PDF.
- Paid subscriptions are billed in advance, monthly or annually as you choose, and renew automatically until canceled. Annual billing is optional.
- Extra users and add-ons, where offered, are billed with the subscription at the published price.
- Payment is by card through our payment processor (Stripe), or through Apple or Google when you subscribe in their app stores, under their terms.
- If a payment fails we try again and may limit the account to read-only until it is resolved.
- We may change prices with at least 30 days' notice; a change applies from your next billing period, and you can cancel before it does.
6. Cancellation and refunds
You can cancel at any time in the app or by e-mail to info@designmastersolutions.com. You keep access until the end of the period you paid for. There is no long-term contract.
First-time subscribers can ask for a full refund within 30 days of their first payment. This does not apply to renewals or to usage-based purchases. Refunds go back to the original payment method within 5 to 10 business days. Purchases made through Apple or Google are refunded under their policies.
7. AI features
Cabinet Project uses AI to read manufacturer price lists from PDFs and spreadsheets and to render a kitchen photo in a chosen door style and finish. AI output is an estimate: you review imported prices before they are used in a quote, and a render is an illustration, not a specification. You are responsible for the prices, quotes and orders you send.
8. Your data
You own the data you and your team put into the Service: your clients' contact details, projects, quotes, orders, layouts, photos, files and invoices ("Customer Data"). We do not sell it. You give us a limited license to store, process and transmit Customer Data only to run the Service for you, as described in the Privacy Policy.
You are responsible for having the right to collect and use your clients' information in the Service and for the content you upload. We can export your Customer Data on request, and we delete it as described in the Privacy Policy.
9. Payments to you from your clients
When you take card payments through the client portal, the payment is processed by your own payment account (for example, your own Stripe account), under your agreement with that provider. You are the merchant. We do not hold your funds and are not a party to the sale between you and your client.
10. Acceptable use
You agree not to:
- upload illegal, fraudulent or deceptive content, or material you have no right to use;
- send spam or unsolicited messages through the Service;
- transmit malware or try to access accounts or data that are not yours;
- reverse engineer, scrape or overload the Service, or resell it without our written permission;
- impersonate anyone, or use the Service in breach of any law.
11. Intellectual property
The Service, including its software, design, logos and documentation, belongs to Design Master Solutions LLC. While your subscription is active you have a limited, non-exclusive, non-transferable license to use it for your business. All rights not expressly granted are reserved. Manufacturer names, catalogs and trademarks belong to their owners.
12. Third-party services
Some features connect to services you choose to use, such as Stripe, QuickBooks Online, Google or Apple sign-in. Your use of those services is governed by their own terms, and we are not responsible for them.
13. Disclaimer and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, AND WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION;
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION;
- OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Design Master Solutions LLC and its officers, employees and agents from claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Customer Data, your dealings with your clients, or your breach of these Terms.
15. Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA. Before starting a formal dispute, write to info@designmastersolutions.com so we can try to resolve it. Disputes that cannot be resolved that way go to binding arbitration administered by the American Arbitration Association (AAA). You and we agree to bring claims only individually, not as part of a class action or class arbitration.
16. Suspension and termination
We may suspend or close an account that breaches these Terms, is used for fraud or is not paid, or, for any other reason, with 30 days' written notice. After termination you can ask for an export of your Customer Data for 90 days.
17. Changes to these Terms
We will tell you about material changes by e-mail and in the app at least 30 days before they take effect. Using the Service after that date means you accept the new Terms.
